Select Cannabis Settlement: Cura Cannabis to pay $500,000 to Oregon Citizens

Curaleaf Cannabis owners have agreed to a $500,000 fund for the Select Cannabis settlement. Between 2018-2019, around 186,000 Oregon citizens purchased mislabeled Select vape devices. The product labels were missing vital information on the ingredients, failing to mention the presence of botanical terpenes. As a result, CBD and THC product lines became mixed up and sold to unknowing customers. This is the second major mistake with possible health implications that a Curaleaf company has made. 

If you purchased certain Select products, you may be entitled to compensation. 

Who Will Be Compensated?

According to Benzinga, compensation will be given to Oregon residents who are over the age of 21 that purchased mislabeled products from the Select Elite, Select Pax, and/or Select Dabbables product lines during August 15, 2018 through November 22, 2019. Additionally, the Select Cannabis settlement will provide compensation for cartridges, disposable pens, and pods purchased from the product lines.

How Will People Be Compensated?

Cura Partners Inc agreed to pay $500,000 to the Select Cannabis settlement fund. These funds will cover attorney fees to class counsel as well as $200 on each approved claim. The fixed compensation, however, might decrease depending on the number of submitted claims it takes until the fund is exhausted. 

What Are The Options For Those Affected?

File a Claim. To receive compensation in cash, download and file a claim form at  www.oregonclassactionsettlement.com. Forms must be submitted before April 29, 2022. 

Exclude Yourself From the Class. According to Curaleaf “This is the only option that allows you to ever bring or join another lawsuit that raises the same legal claims against Cura released by this settlement”. The deadline for this action is April 29th. 

Object to the Select Cannabis settlement. Affected parties are welcome to write to the court about their reasons for disliking the settlement as well as attorney fees, or the payment to the plaintiff. 

For those unaffected, you can still go to the hearing. Citizens are also able to speak about the Select Cannabis settlement in court. The hearing will take place on May 11, 2022. 

The final option would be to do nothing. If you choose not to exclude yourself, you remain bound to the court’s hearing. This means you will have no right to sue later if the settlement is approved.
