What is Delta-8 THC?
Delta-8 THC is getting some serious attention, with even national publications such as Rolling Stone printing features on it. Delta-8 is very similar to its cousin, the much better known and psychoactive Delta-9 Tetrahydrocannabinol (THC). In fact, the difference between the two compounds is not much more than a few atomic bonds.
There are over 400 compounds and over 100 cannabinoids in the cannabis plant. Delta-8 is just one of the many. Unlike its cousin Delta-9, Delta-8 is typically only found in trace amounts of the harvested cannabis flower. Do Delta-8 Products Offer Therapeutic Benefits?

What Does Science Say About Delta-8?
Because Delta-9 is the most abundant cannabinoid in the cannabis plant, it has garnered by far the most attention. Luckily, this means its been given the most scientific research. However, studies show that Delta-8 binds to the brain’s CB1 and CB2 receptors, thus reducing nausea, and acting as an anti-inflammatory.
A study was conducted way back in 1995, indicating how Delta-8 has promising therapeutic potential. The authors of the study call Delta-8 “an efficient new cannabinoid antiemetic in pediatric oncology” – administering isolated Delta-8 to children under 13 who were suffering from hematologic cancer.
The promising study indicates that the majority of the children show a noticeable reduction in the side effects that accompany chemotherapy and other treatments for cancer. The most notable of which is that the children’s nausea and vomiting were greatly reduced, and in some cases were non-existent.
Is Delta-8 Legal?
Thanks to the 2018 Farm Bill, Delta-8 is currently legal in 38 states. The Farm Bill states hemp plants are legal to grow and possess nationwide, as long as they contain less than 0.03% Delta-9 THC. After over 80 years of cannabis prohibition, the Farm Bill effectively removes hemp and its derivatives from the list of illicit and illegal substances. Thanks to this, retailers may legally sell products containing Delta-8, like cartridges, edibles, and concentrates.
As long as Delta-8 products contain less than 0.03% Delta-9, they are perfectly legal. However, the process of altering CBD into Delta-8 THC synthetically is illegal in some states and thus exists in a relatively legal-grey area. Products like K2 and Spice are dangerous attempts to synthesize cannabinoids that are illegal thanks to the Obama administration. Quality, lab-tested Delta-8 products are not comparable to these dangerous products. Federal agencies are discussing the future of Delta-8, but for now, it’s perfectly legal in most states.
While Delta-8 is legal at the federal level currently, some states have either completely banned or restricted the sale of such products. These states include Alaska, Arizona, Arkansas, Colorado, Delaware, Kentucky, Idaho, Iowa, Mississippi, Montana, New York, Rhode Island, Utah, Vermont, and Washington.
